Terms of Service
These Terms of Service govern all quotations, purchase orders, and sales of custom metal nameplates, badges, and related products by CustMetalPlate. Last updated: October 2026.
1. Acceptance of terms
By requesting a quotation, placing an order, or using custmetalplate.com, you (“the Buyer” or “you”) agree to these Terms. Any conflicting or additional terms on your purchase order do not apply unless we agree to them in writing.
2. Quotations and order acceptance
- Quotations are valid for 30 days from the date issued, unless stated otherwise, and are subject to change in material, freight, or exchange rates.
- An order is not accepted until we issue a pro-forma invoice (PI) or sales confirmation and the deposit is received.
- Product specifications, quantities, materials, finishes, packaging, and prices are those stated on the PI or confirmed in writing.
3. Custom products and artwork
Our products are custom-made to your specifications. You are responsible for providing accurate, complete artwork, logos, text, dimensions, and technical files, and for ensuring that you have the legal right to use all trademarks, logos, and designs supplied.
- You approve a digital proof or sample before mass production; approved artwork is the manufacturing standard.
- We are not responsible for design errors, spelling, trademark, or content issues present in artwork you approved.
- We may decline orders that appear unlawful, infringing, or counterfeit.
4. Pricing and payment
- Unless otherwise stated, prices are in US Dollars and are quoted EXW or FOB China; freight, insurance, duties, and taxes are not included unless a DDP term is stated on the PI.
- Standard terms are 30%–50% deposit by bank transfer (T/T) with the balance paid before shipment; exact terms are shown on the PI. Samples and tooling may require full prepayment.
- Bank and transfer fees are borne by the Buyer.
- Orders enter production only after the deposit is cleared and the artwork is approved.
5. Lead times
Lead times are estimates counted from deposit clearance and artwork approval. Samples typically take about 5–10 working days and mass production about 15–30 working days, depending on process, quantity, and finish. Lead times are not guaranteed; we are not liable for delays caused by shipping carriers, customs, or events beyond our control (see Shipping & Delivery Policy).
6. Specifications and tolerances
Custom metal products are subject to reasonable industry tolerances in dimensions, thickness, color, and finish, and minor batch variations in metal, anodizing, plating, or print are normal. Monitors may display colors differently from physical products. Minor variations within industry standards do not constitute defects.
7. Delivery, risk, and title
Delivery is made under the Incoterms stated on the PI (default EXW/FOB). Risk passes to the Buyer when the goods are handed to the first carrier. Ownership of the goods passes only after full payment is received.
8. Warranty and returns
We warrant that products will substantially conform to the approved artwork and PI at the time of shipment. Claims for non-conforming or defective goods are governed by our Returns & Refund Policy, which must be reviewed within seven (7) days of receipt.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from an order shall not exceed the amount paid for the products giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, loss of profit, or third-party claims.
10. Intellectual property
You retain ownership of your trademarks and artwork, and you indemnify us against claims arising from content you supply. Our manufacturing know-how, tooling, processes, and the website content remain our property. Production of custom goods does not transfer our manufacturing intellectual property.
11. Confidentiality
We treat your designs, files, and commercial information as confidential and use them only to produce and deliver your order, subject to the Privacy Policy.
12. Force majeure
We are not liable for failure or delay caused by events beyond reasonable control, including natural disasters, fire, flood, earthquake, pandemic, power failure, war, terrorism, government action, labor disputes, raw-material shortages, or carrier/customs disruption.
13. Governing law and disputes
The parties will first try to resolve any dispute in good faith. If unresolved, disputes shall be settled in accordance with the law and courts at the Seller’s location, unless the parties agree in writing to alternative arbitration. The UN Convention on Contracts for the International Sale of Goods may be excluded where permitted.
14. Changes to terms
We may revise these Terms; the version in effect at the time of your quotation or PI applies to that order. Continuing to use the website after changes constitutes acceptance.
